Terms of Service

1. Agreement. By using Fortun8.ai (operated by Fortun8 LLC, a Missouri limited liability company at 575 Camp Creek Rd, Highlandville, MO 65669) you agree to these terms.

2. Services. Fortun8.ai provides AI-powered call answering, missed-call text-back automation, marketing audits, and related marketing services for residential HVAC contractors. Specifics depend on the plan you select.

3. Free Money Leak Report. The Money Leak Report is provided at no charge as a one-time audit. Submission of company name, ZIP, and email constitutes consent for us to perform the audit and email you the result. We may use anonymized aggregate findings for benchmarking. We will not contact you with sales calls based on a Money Leak Report submission.

4. Paid plans. Plans range from $397 to $997 per month. Billing begins when implementation starts. No long-term contracts; cancel anytime with 30-day notice.

5. Tier 1 60-day guarantee. Tier 1 ("AI Receptionist") customers who do not receive at least 12 qualified warm leads within 60 days of go-live receive a refund of the most recent month's payment. A "warm lead" is defined as a missed-call event where the AI engaged the caller, captured contact information, and identified service interest. Refund requests must be submitted within 14 days of the 60-day mark.

6. Acceptable use. You may not use the platform for fraudulent, illegal, or harmful purposes; to send unsolicited messages outside applicable consent rules (TCPA, A2P 10DLC, etc.); or to impersonate another business.

7. Intellectual property. We retain all rights to the platform, software, audit methodologies, and Fortun8.ai brand. You retain all rights to your customer data.

8. Limitation of liability. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the prior 12 months. We are not liable for indirect, incidental, or consequential damages.

9. Governing law. Missouri. Venue: Greene County, Missouri.

10. Changes. We may update these terms with 30 days' notice for material changes. Continued use constitutes acceptance.
